Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and RubyVox ("RubyVox," "we," "us," or "our"), a company operating from Dallas, Texas, USA. They govern your use of rubyvox.com, our subdomains, the RubyVox web app, and any voice agents you create or interact with on our platform (the "Services").

By using the Services you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

1. Accounts

You must be at least 13 years old and able to form a binding contract. You are responsible for the accuracy of your registration information, for keeping your credentials secret, and for all activity under your account. Notify us at security@rubyvox.com if you suspect unauthorized access.

2. Your content and license to us

"Builder Content" means the instructions, knowledge, branding, voices, and other materials you upload or configure. You keep ownership of Builder Content. You grant RubyVox a worldwide, non-exclusive, royalty-free license to host, transmit, process, and display Builder Content solely to operate the Services on your behalf.

You represent that you have all rights necessary to upload the Builder Content and that it does not infringe or violate anyone's rights or the law.

3. Acceptable use

You will not use the Services to:

  • Impersonate a real person or organization without authorization.
  • Deceive callers about the fact they are talking to an AI when a jurisdiction requires disclosure.
  • Provide medical, legal, financial, or other professional advice as if licensed to do so, unless you are.
  • Collect information from callers without proper notice and consent.
  • Send unsolicited or unlawful SMS or voice traffic, or violate TCPA, CAN-SPAM, or similar rules.
  • Attempt to breach security, reverse engineer, or interfere with the Services.
  • Upload malware, harmful content, or content that is defamatory, obscene, harassing, or discriminatory.
  • Use the Services to build or benchmark a competing product.
  • Exceed usage caps or attempt to bypass rate limits.

We can suspend or terminate any account we believe is violating these rules, with or without notice.

4. AI outputs

Voice agent responses are generated by large language models and speech synthesis. Outputs can be inaccurate, incomplete, or offensive. You are responsible for how you configure your agent, for reviewing outputs, and for the consequences of any action taken based on them. Do not rely on the Services for decisions that require licensed professional advice or that could cause harm.

5. Telephony, SMS, and TCPA

When you enable outbound calling or SMS, you are the sender under applicable law (including the TCPA in the U.S.). You are solely responsible for obtaining any required prior express consent from recipients, honoring opt-outs, and complying with carrier rules including 10DLC and toll-free registration. RubyVox provides tools to help; it does not become the sender for your traffic.

6. Plans, billing, and usage caps

Paid plans renew automatically until canceled. Fees are non-refundable except where required by law. We may change prices with at least 30 days' notice, effective at the next renewal. Usage caps (per call and per period) apply to free and paid plans; traffic exceeding a cap may be paused or throttled. Telephony overages, if any, are billed at the rates posted in the dashboard.

7. Third-party services

The Services depend on third parties including Supabase, ElevenLabs, Telnyx, Twilio, Simli, Cloudflare, Cal.com, and Google. Those services have their own terms. We are not responsible for third-party failures, outages, or changes.

8. Intellectual property

RubyVox and its licensors own the Services, including all software, designs, and trademarks. Except for the limited rights we grant you in these Terms, all rights are reserved. Feedback you send us may be used without restriction or compensation.

9. DMCA

If you believe content on the Services infringes your copyright, send a DMCA notice with the information required by 17 U.S.C. § 512(c)(3) to dmca@rubyvox.com. We will respond as required by law.

10. Termination

You may stop using the Services at any time and delete your account from the dashboard. We may suspend or terminate accounts that violate these Terms or that expose RubyVox to legal, security, or reputational risk. Sections that by their nature should survive termination will survive.

11. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT THE SERVICES WILL MEET YOUR REQUIREMENTS OR THAT AI OUTPUTS WILL BE ACCURATE OR APPROPRIATE.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RUBYVOX WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS.

13. Indemnification

You will indemnify and hold harmless RubyVox and its officers, employees, and agents from any claim, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your Builder Content, your use of the Services, your telephony traffic, or your violation of these Terms or applicable law.

14. Governing law and venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. The exclusive venue for any dispute is the state and federal courts located in Dallas County, Texas, and you consent to personal jurisdiction there.

15. Changes

We may update these Terms from time to time. Material changes will be announced in the app or by email. Continued use after the effective date means you accept the revised Terms.

16. Miscellaneous

These Terms, together with the Privacy Policy and any plan-specific terms, are the entire agreement between you and RubyVox regarding the Services. If a provision is unenforceable, the rest remain in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms; we may assign them to an affiliate or in connection with a merger or asset sale.
